Partnering with Hall Render and Spectrum Health, SullivanCotter's Ted Tackett will take part in an upcoming webinar entitled "Compensation Rules Under the New Stark Laws".

The presentation will include a discussion of new federal guidelines for value-based payment arrangements under the Physician Self Referral Law - more commonly known as Stark Law.

The session will outline:

• Separate and distinct requirements for fair market value, commercial reasonableness and the “volume or value” standard, and guidance on documenting compliance and engaging with external appraisers.
• Special considerations surrounding FMV, including existing relationships with physicians that may not fit squarely within the framework or circumstances that may dictate veering from values identified in healthcare salary surveys.
• The revised definition of commercially reasonable and what is allowed, like arrangements not all based on profit.
• When compensation accounts for the volume or value of a physician’s designated health services referrals or other business generated.
• Reengage physicians to develop compliant and sustainable models that address pandemic-related coverage challenges, changes to the Medicare Physician Fee Schedule and care coordination, quality and cost-containment.
